Just in case you missed the memo, Kiwis who arrive in Australia are not automatically permanent residents or citizens, even though they can live and work there indefinitely. Never fear though, there are ways for Kiwis to get citizenship in Australia.
Current situation
Starting in September 1994, Kiwis are granted temporary visas on arrival at customs, known as a Special Category Visa. This visa expires when you leave and you are granted a new one when you return to Australia.
If you are a Kiwi living in Australia and you plan on making it your home for the foreseeable future, you should get Australian citizenship.
It will give you better rights and more security in Australia, and it will not impact your New Zealand citizenship. You can be a citizen of both countries without any problems.
To be granted Australian citizenship you must hold a Protected Special Category Visa, or be granted a permanent visa first.
There are currently two ‘easy’ options for Kiwis to be granted permanent residency. These are:
- the Resident Return Visa
- the Skilled Independent Visa (subclass 189) New Zealand stream

Protected Special Category Visa
Kiwis hold a Protected Special Category Visa if they:
- were in Australia on 26 February 2001, or
- had resided in Australia for at least 12 months during the two years immediately prior to 26 February 2001; or
- are eligible for a Certificate of Australian Residence.
They can apply for citizenship right away so long as they have resided in Australia for the four years immediately prior to applying.
Resident Return Visas
Kiwis are eligible for Resident Return Visas if they cleared Australian Customs on a New Zealand passport prior to 1 September 1994. They are eligible even if they were only on a short holiday. They must be living in Australia now to apply for one.
Skilled Independent visa (subclass 189) New Zealand stream
Kiwis are eligible to apply for this visa if they:
- have a non-protected Special Category Visa;
- began living in Australia on or before 19 February 2016;
- have usually resided in Australia for the five years immediately prior to applying;
- have either earned the taxable income threshold (currently at least $53,900 per annum) or meet the criteria for an income exemption; and
- satisfy health and character checks.
Kiwis can apply for citizenship one year after this visa is granted. As mentioned this visa is currently closed to new applications and it is due to open again on 1 July 2023.
If none of the three options apply to you – do not despair. You may be able to go down the general skilled migration route.
Family
If your family does not have Australian permanent residency or citizenship, they can be included in a Skilled Independent Visa (subclass 189) New Zealand stream application.
However you cannot include them in a Resident Return Visa application or citizenship application if you hold a Protected Special Category Visa. You will have to sponsor them later.
